1. Introduction

Welcome to TITO STYLE. By accessing and using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

2. Definitions

• "Agreement" refers to these Terms and Conditions.

• "Client" refers to the individual or entity purchasing services from TITO STYLE.

• "Services" refers to the styling and consultancy services provided by TITO STYLE.

• "Stylist" refers to TITO STYLE.
   

3. Term of Agreement

(a) This Agreement begins on the date the Client accepts the Terms and continues until the completion of the services or termination by either party as outlined in these terms.

(b) The Agreement may be extended or terminated by mutual written consent..

4. Provision of Services

(a) TITO STYLE agrees to provide the Services as outlined in the service agreement or invoice.

(b) The Stylist will:

• Complete the Services by the agreed completion date.

• Notify the Client promptly of any potential delays.

• Provide services with the care, skill, and diligence expected of a professional in the industry.

• Use qualified personnel to deliver the Services.
   

5. Fees and Payment

(a) The fees for the Services are as outlined in the service agreement or invoice.

(b) Payment terms will be specified in the invoice, with payment due within 24 hours of receipt unless otherwise stated on the invoice.

(c) TITO STYLE reserves the right to require a deposit before commencing work.

(d) A 50% deposit is required on the day the Client books the service, and the remaining 50% is required 7 days before the service commences.

(e) Invoices will include all relevant information required for GST purposes.

(f) Late payments beyond 7 days will incur an interest charge of 10% per week. This charge will continue to accrue at a rate of 10% per week thereafter until the outstanding amount is settled in full. The Client acknowledges and agrees that such charges constitute a reasonable estimate of the costs incurred due to late payment and are not a penalty.

(g) If travel is required for the provision of services using a personal vehicle, the Client will be charged at a rate of 50% of the stylist’s hourly rate plus $0.85 per kilometre to cover both travel time and fuel costs, in line with the Australian Taxation Office (ATO) mileage rate.

6. Cancellations and Refunds

(a) The Client may cancel the services by providing written notice to TITO STYLE.

(b) If the Client cancels the services, TITO STYLE will retain the deposit to cover work already performed and any expenses incurred.

(c) Refunds will be issued for any services not rendered, less any applicable fees for work completed. Services must be used within 12 months of the original signed contract.

7. Intellectual Property

(a) All materials created by TITO STYLE during the provision of the Services remain the property of TITO STYLE unless otherwise agreed in writing.

(b) The Client is granted a non-exclusive, royalty-free license to use the materials for personal use only.

(c) Any pre-existing intellectual property used during the Services remains the property of the respective owner.
 

8. Confidentiality and Privacy

(a) TITO STYLE will maintain the confidentiality of all personal information provided by the Client.

(b) The Stylist will comply with the Australian Privacy Principles as outlined in the Privacy Act 1988.

(c) Personal information will only be used for the purpose of providing the Services and will not be disclosed to third parties without the Client’s consent, except as required by law.

9. Liability

(a) TITO STYLE will take all reasonable care in providing the Services. However, the Stylist is not liable for any loss or damage arising from the use of the Services.

(b) The Client agrees to indemnify TITO STYLE against any claims, damages, or expenses arising from the Client’s use of the Services.

(c) TITO STYLE is not responsible for any decisions made by the Client based on the stylist's recommendations.

10. Termination

(a) TITO STYLE may terminate this Agreement with immediate effect if the Client breaches any terms of the Agreement.

(b) The Client may terminate the Agreement by providing written notice. In such cases, TITO STYLE will retain fees for services performed and may charge for any additional costs incurred due to the termination.

11. Dispute Resolution

(a) Any disputes arising from this Agreement will be addressed through good faith negotiations between the parties.

(b) If a dispute cannot be resolved amicably, it will be referred to mediation or arbitration as agreed by both parties.

12. Governing Law

This Agreement is governed by the laws of the State of Victoria, Australia. Any legal actions or proceedings arising under this Agreement will be subject to the jurisdiction of the courts in Victoria, Australia. 

13. Amendments

TITO STYLE reserves the right to amend these Terms and Conditions at any time. The Client will be notified of any changes, and continued use of the Services constitutes acceptance of the amended terms.

14. Code of Conduct

(a) The Stylist will act professionally and ethically in all dealings with Clients.

(b) The Client acknowledges that styling services are a professional advisory relationship and not therapy or counselling.

(c) The Client is responsible for their own decisions, purchases, and personal achievements.
